1. Agreement to Terms

By accessing our website at writeoffjosh.com, booking a call, or engaging with any of our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These Terms apply to all visitors, clients, and anyone who accesses or uses the services provided by Writeoff Josh ("Company," "we," "us," or "our"), located in North Hollywood, California.

2. Services Provided

Writeoff Josh provides AI-powered business automation services including but not limited to:

  • Missed call text back automation systems
  • AI voice appointment setting agents
  • Automated SMS follow-up sequences
  • AI-powered social media content creation and scheduling
  • GoHighLevel CRM setup and management
  • AI video clone content using HeyGen technology

Service details, deliverables, and pricing are agreed upon separately in a client service agreement or invoice prior to the start of any engagement.

3. SMS Messaging Terms — A2P Compliance

By providing your phone number to Writeoff Josh, you expressly consent to receive automated SMS text messages from us regarding our services, appointment scheduling, and business communications. This consent is not a condition of purchase. Message and data rates may apply.

Message frequency: Message frequency varies based on your interactions with us and the services you receive.

To opt out: Reply STOP to any SMS message at any time. You will receive one final confirmation and no further messages will be sent.

No third-party sharing: We do not share your phone number or consent data with third parties for marketing purposes.

Our SMS messaging operates in compliance with the TCPA (Telephone Consumer Protection Act), A2P 10DLC regulations, and carrier guidelines. All SMS campaigns are registered through proper 10DLC channels.

4. Client Responsibilities

As a client of Writeoff Josh, you agree to:

  • Provide accurate business information required to set up and operate your systems
  • Ensure your business has obtained proper consent from your customers before we send SMS messages on your behalf
  • Comply with all applicable laws regarding SMS marketing and customer communications in your industry
  • Not use our services for any unlawful, deceptive, or harmful purpose
  • Promptly review and approve content (scripts, videos, posts) within agreed timelines
  • Maintain current payment for ongoing monthly services

5. Payment Terms

All services are billed on a monthly recurring basis unless otherwise agreed in writing. Payments are due at the start of each billing cycle. We accept payment via Stripe or other agreed payment methods.

  • Cancellation: You may cancel your service at any time with written notice. Cancellations take effect at the end of the current billing period. No partial refunds are issued for unused portions of a billing period.
  • Late payments: Services may be paused if payment is not received within 7 days of the due date.
  • Setup fees: Any one-time setup fees are non-refundable once work has commenced.

6. Intellectual Property

All content, systems, workflows, and automations created by Writeoff Josh remain the intellectual property of Writeoff Josh until full payment is received. Upon full payment, clients receive a license to use deliverables for their business purposes.

Clients grant Writeoff Josh permission to use their business name, logo, and general results (anonymized where requested) for portfolio and marketing purposes unless explicitly opted out in writing.

7. AI Content and Video Cloning

For clients using our AI video clone services powered by HeyGen:

  • You represent that you have the legal right to use your own likeness for AI-generated content
  • You consent to Writeoff Josh creating AI-generated video content using your recorded likeness for agreed business purposes only
  • AI-generated content will not be used outside of agreed platforms without your written approval
  • You understand that AI-generated content may require disclosure on certain platforms and agree to comply with applicable platform policies

8. Disclaimer of Warranties

Our services are provided "as is." While we work hard to deliver results, Writeoff Josh does not guarantee specific business outcomes, revenue increases, or lead generation results. Marketing and automation results vary based on your business, market, and many factors outside our control.

We are not responsible for downtime or changes in third-party platforms including GoHighLevel, HeyGen, TikTok, Instagram, or any other platform we use to deliver services.

9. Limitation of Liability

To the fullest extent permitted by law, Writeoff Josh shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability to you for any claim shall not exceed the amount you paid us in the 30 days prior to the claim.

10. Governing Law

These Terms of Service are governed by the laws of the State of California. Any disputes arising under these terms shall be resolved in Los Angeles County, California.

11. Changes to These Terms

We reserve the right to update these Terms at any time. We will notify active clients of material changes via email or SMS. Continued use of our services after changes constitutes acceptance of the updated terms.
